Laws, Lawyers, and Punishment in the Victorian Period The Law â⬠¢At the beginning of the 19th century there were 3 types of law in England: -Common Law: the ââ¬Å"law of the landâ⬠(Pool 127), which was built up over many centuries *referred to in order to determine such cases as the validity of a contract or whether or not someone was guilty of murder â⬠¢3 courts that heard cases: -Kingââ¬â¢s Bench- criminal cases -Eschequer- disputes about money -Common Pleas- disputes between citizens -Equity: seen over by the Chancery Court; designed to give relief from strict decisions made by the common law -Church Law: 4 courts -Court of Arches-Court of the archbishop -Court of Faculties-granted special permission to do things such as hold multiple livings -Consistory Court-handled divorce and wills -Prerogative Court- wills of bishops However, this system of laws changed much throughout the century. The Chancery became merely a joke for there you could not present evidence during trials and Parliament came to view it as necessary for matters of will and divorce to be referred to new civil courts instead of the church. In 1873 the 3 common law courts and the Chancery were combined to make the Supreme Court Lawyers â⬠¢There were two types of lawyers: -those who argued in court- barristers, sarjeants, and advocates -those who prepared the cases for these lawyers- attorneys, solicitors, proctors â⬠¢Courtroom lawyers held more prestige especially the barrister, who was often well born â⬠¢To become a barrister one had to go to a certain number of dinners at the Inns of Court for 3 years. Then if you were approved of by the older lawyers youââ¬â¢d be ââ¬Å"called to the barâ⬠and then could become a barrister. There was no exam required. â⬠¢Solicitors had to serve as an in-between between the barristers and their clients. So they were ââ¬Å"in tradeâ⬠which was less respectful to become solicitor one had to be an apprentice for 5 years to a practicing lawyer Punishment â⬠¢In 1800 there were over 200 offences punishable by death including sheep stealing and doing damage to the Westminster Bridge -This harshness was probably due to the lack of real paid policemen at the time. So when someone was actually caught and convicted they were made an example.

Midterm Reflection: Health Literacy Essay
When listening or reading to the news, it is hard to avoid a topic on the health care crisis. It seems that everyone has an opinion on what needs to be fixed, but there is one underlying factor in the system that could be a key player in the delivery of health care for the future. Health literacy has become an issue that is affecting every part of the system, and could be a path leading to improvements in the system (Nutbeam, 2000). After watching the health literacy video exposing various Americans with low health literacy, I was completely shocked. I had heard of health literacy before, but seeing this video was really eye-opening as to the extent that people cannot communicate with health care providers. I knew right away that this was a topic that I wanted to explore. When learning about health literacy, I found it important to note the similarities and differences in health literacy and literacy. Literacy can be defined as oneââ¬â¢s ability to read, write, or understand written and spoken language in his or her native language. Health literacy is different to literacy, as it is oneââ¬â¢s ability to understand the terms of health and apply that knowledge within the scope of health care (Mayer and Villaire, 2007). However, literacy plays an undeniable role in health literacy, in that those that are illiterate will have an even harder time when trying to understand health terms. While watching the movie about health literacy in class, I could not help but be disturbed when watching adults that had the literacy levels of middle school children (Kalmbach, 2003). It made me wonder how many people are illiterate in the country, and how this is playing a role in health care. The National Assessment of Adult Literacy (NAAL) offers extensive information on past studies done on adults for literacy. A study conducted in 2003 showed that thirty million adults (about fourteen percent) had literacy levels below basic, which includes simple, minimal skills. In addition, sixty-three million, or twenty-nine percent of adults, had a literacy level of ââ¬Å"basic,â⬠which means that simple, everyday skills are met, but nothing beyond that. Knowing this, it is clear that there is a problem in America with literacy in adults. With adults that cannot meet even intermediate literacy skills, that means that over 100 million adults are health illiterate because people that are illiterate tend to also be health illiterate (ââ¬Å"National Assessment,â⬠2003). Some of these adults may have health care plans, and their lack of literacy may be preventing them from understanding those plans and understanding the services with which they are provided through those plans. Because there is correlation with literacy and socio-economic class, I believe that there needs to be more emphasis put on educating those that have not been properly educated (Mayer and Villaire, 2007). Healthy People 2020 has a great system for approaching this goal in terms of health literacy, but more promotion of this movement is critical (ââ¬Å"Educational and Community-Based,â⬠2011). In the movie, Mr. Brown reads at the fourth-grade level. Due to this low literacy level, he says that he does not like going to the doctor because of the amount of paperwork he needs to fill out. Even being someone that can read at a proficient level, I can agree with Mr. Brown that filling out paperwork at a doctorââ¬â¢s office can be stressful. There are many abbreviations and words that relate to health care that I simply do not know. However, because of my literacy level, I am able to overcome some of these problems and figure out what the form is asking. It concerns me that people of a low literacy level such as Mr. Brownââ¬â¢s would not be able to do this problem-solving successfully (Kalmbach, 2003). There is no doubt that this can lead to medical miscommunications between the patient and the doctor in regards to billing, medical background information, and future diagnoses and prescriptions. These miscommunications can be costly for insurers, those paying out-of-pocket, and the physicians (Mayer and Villaire, 2007). As a college student, I still have much to learn about living independently without the help of my parents. After learning about health literacy, I feel that I need to educate myself and become more health literate. Because I am a biology major, and I am interested in science, I do try to communicate well and fully understand what my doctor is telling me, but I do not always ask all of the questions needed to improve my health literacy. For example, when I am prescribed a medication, I normally take it without knowing why I am taking that specific dosage, what it will do for me, what side-effects it may cause, etc. Those are questions that I, and others that go to a physician, should be asking. College students are in the years where they prepare for living on our own. Part of that preparation should be becoming more health literate in order to make the best decisions regarding health care options in the present and future. In a study of college students, 21. 7% of the students could not appropriately take a medication four times throughout one day, and 41. 4% would not figure out financing for primary care when taking family size and income into consideration. Since these are issues that may be in the near future for college students, this implies that something needs to be done to better educate students. Melinda Ickes and Randall Cottrell (2010) say that a possible solution to improving health literacy would be to offer consumer health courses. I believe that this could be an option, but there needs to be a great incentive, or it must be mandatory for students to take these courses; with the combination of a busy course load and students simply not knowing their health literacy levels, many students may not enroll. One growing issue with health literacy that I find extremely interesting is the effect that the Internet has played in health care over the past couple decades (Ickes and Cottrell, 2010). As more information about health care is available on the Internet, many people find it more convenient to self-diagnose themselves instead of making the trip to the doctor. I know that when I have a health problem, one of the first things that I do is look it up on a website such as WebMD. While some people, like myself, know that this is not sufficient information, others that are not as health literate may not understand that the most reliable source is a face-to-face interaction with a physician. When a doctor visit becomes necessary, doctors may then have the task of re-teaching the medical information if a person relied heavily on the wrong information from the Internet. This is not just a problem locally or nationally. The Internet is worldwide, so this problem of becoming Internet-dependent for health care may be affecting global health literacy and therefore the quality of global health care. Though those that do not have access to health insurance and cannot see a physician may find this to be easy access at the fingertips, proper health literacy is needed to interpret the information in a way that is safe (Lancellotti-Young and Suk, n. d. ). Because I want to be a genetic counselor, health literacy will definitely play a major role in my future practice. Genetic counselors are responsible for doing genetic tests, interpreting those tests, and communicating results with patients effectively. Having a good understanding of the health literacy of my patients will be critical when advising them to make safe decisions for their health and the health of their future children. Especially in regard to sex education and prevention, health literacy is a problem that needs to be addressed in a major way. With more understanding of the benefits and results of genetic testing and prenatal care, patients may be able to make adjustments related to health and financing health care (ââ¬Å"Health Literacy,â⬠2010). In my practice, I would highly value health literacy and make an effort to incorporate health literacy education into my practice as much as possible. Health literacy is a growing topic in health care, as it should be. Someone that can effectively communicate with a physician well may be saving time and money for themselves, the physician, and the insurance provider. However, many adults that are responsible for their own health care are not health-literate on a proficient level. While current news has put emphasis on many aspects of health care such as financing and access, health literacy should be emphasized more, especially because it could potentially benefit those financing and access issues (Nutbeam 2000). Watching the health literacy video gave me a perspective on health care that I did not have before. Not only did I begin to learn of this issue on a national level, but I realized that I need to educate myself so that I can become more health literate to be a better contributor to the health care system. Changing police culture Essay
The New Zealand police for the last 30 years has faced an unfriendly and an unprofessional police culture that has infringed on both the rights of fellow police offices and those of the society as a whole. This culture of open and fear less sexual misconduct and harassment of women through rape and other forms of sexual assaults. Reports indicate that most of the alleged perpetrators of these violence are high ranking policemen like the police commissioner himself. In the year 2007, the police commissioner gave findings on changing the police culture to give confidence to the public on the utility of the New Zealand police. There rests several critical elements that could hinder successful implementation of the recommendations by Margaret Bazley commission. First and foremost, I think the time lapse when the New Zealand police had started committing these types of insults had created a different culture amongst them. Culture in this respect means a shared organizational values and beliefs as well as norms that guide the action of individuals. Most of it was concentrated within the police force itself with policewomen victims of their colleagues. This is a major critical point towards the implementation of the police culture change. It therefore needs to be taken on board to achieve results for the New Zealand police and their acceptable conduct. In addition to this, the tradition that what they used to do was right according to them it portrayd a major challenge to abandon such behaviors. Their socialization and mental orientation become a stumbling block to a swift adoption of a crime free police force. Changing a culture is a process that needs time and it goes in steps. The other challenge is engraved on leadership and the wide spread misconduct of the police force across all ranks up to the commissioner. This goes ahead to crimes committed in the vicinity of the police commissioner and no action is taken. This confirms that down to the juniors, the situation is incomparable. For there to be positive change, I think there must be a radical move that exempts none of the alleged victims. The biggest problem now arises on who among them arrests the victims. Organizational culture involves status assumption in organizations with the leaders being assumed to be role models. With the findings of the investigate magazine, it reaffirms that only top ranking police officers were the perpetrators of sexual violence against their colleagues. A police cover is the worst the police can ever trade with on matters of public interest. In most organizations, bureaucracy is the order and that this cannot be assumed neither altered. This is even terrible because it exist with the top ranking officers since they are the source if information to the public. The lack of a purely independent investigative body of handling police complaints against their fellow officers. It is very hard for the police force to investigate itself on matters of social injustice. Even the government itself cannot perform because it still has to protect the reputation of its workers. It is only a body with no vested interests that can give results on dealing with complaint of the police force. The formation of a body with powers to investigate past crimes committed by the police force meant that the current and the ongoing were lawful to be put on hold awaiting investigation. The long procedural process of going back to 1980s up to 2007 gives the police a lot of confidence in terrorizing their colleagues due to the lack of immediacy in handling the allegations that arise. This is because culture unites people psychologically and includes a mission to meet. The threats to successful implementation of the recommendation is the diversity of offenses by the New Zealand policemen. Most officers are alleged to have committed several offenses. Dewar for example was convicted of four charges. It calls for the police commissioner to take radical steps in resolving the conflict since he is part of the problem. None of the junior police officers can accept to be prosecuted unless the police commissioner starts. Based on their previous culture it is hard for them to break the already held norms. It even goes further such that those officers convicted of crimes threaten to resign then it becomes hard to eradicate the culture. The formation of the ââ¬Å"independent complain authorityâ⬠cannot achieve if the police are not willing. Who will report those cases if the police themselves are already held in one culture? The police commissioner, Mr. Howard Broad was forced to respond to his own allegations of misconduct. He was affected positively and negatively as a leader. On the positive approach, he must have felt challenged that as a role model he had failed his juniors. The best was to try to avoid such suspicious allegations and promise to take responsibility of implementing the entire culture change. The trait theory puts it clearly that leadership is founded on personality. As a human being like any other and having been in a situation of an engraved culture over along time makes him fall in some uncalled for mistakes. However, his colleagues look at him like a teacher. He is very willing to a successful implementation of the recommendation though in a challenging environment. The police commissioner need to take his allegations of his misconduct and reaffirm his colleagues that he is ready to lead like a an example. Leadership is situational so he needs to work hard and give results on culture change. The greatest work ahead of the commissioner is to ask for corporation from the rest of the police. The government has the duty to get a competent person to lead the culture change in the police if Mr. Broadââ¬â¢s efforts are declared inconsequential. Mr. Broad as a leader is fully committed to preserving the reputation of the police however he may be thought of having committed a social misconduct. He says that his role as a police commissioner is to cement the reputation for performance and integrity within the police. This shows how much confident he is in dealing with the scenario. On the other hand, the allegations made on the police commissioner affects his ability negatively. Being the head, many of his junior officers may not take the initiative to listen to his advice. Such will divide the police to those who are loyal to the commissioner and those who are the direct opposite of his commands. This is likely to make work hard for Broad in implementing the recommendations. The inability of Mr Broad to take any action on a pornographic movie shown in his house shows how he is covering his friends. This is likely to persist with other high ranking officers not unless his case brings justice to the aggrieved parties. Here Broads ability is depicted as a failure and even leading the culture change may be hard for him based in peopleââ¬â¢s knowledge of his behavior. Regarding his personality as the lead team in the culture change, Mr Broad has two wars to fight. First, as the police commissioner he has the role of being an example to the whole New Zealand police. They are supposed to view him as a symbol of unity and service to protect the people of New Zealand. On the other hand, he has the duty to protect the reputation of the whole force on the public and give confidence to the public on their commitment to serving them. From the case leading culture change in New Zealand, there are lessons on the issues of managing culture change. Several issues need to be taken into consideration in the process of reforming persistent behaviors. The interest of reforming the police should be based in recognition of collective attitude of the organization as a whole and sideline the attitude of individual officers. The police need to find evidence on misconduct by some police officers and legally deal with officers condoning inappropriate sexual activity. The New Zealand police management lacked inappropriate policies, procedures and practices to deal with unending cases of sexual misconduct. This encompass the unavailability of standards of work amongst the front line staff. This is a shorcoming of many organizations. According to the inquiry done by Bazley, it found that standards varied across police Districts. This inconsistency resulted to the unavailability of procedures to deal with them. To address this, there needs to be drafted code of conduct for sworn police officers. The quality of investigation is vital in handling complaints against police officerââ¬â¢s. The complaints process on the police should be made public top enhance public confidence on the police. Prompt handling of the complaints is vital in radically driving the culture change. However, the force lacks resources to publicize its findings. The government of New Zealand has the duty to invest in the Public Complaints Authority for it to perform its duties. Changing culture of a police force is a process that also involves sustaining public confidence in the police. Police officers need to adhere and demonstrate standards of ethical and moral behavior. The police management system should comprise technocrats in administration who understand culture and organizational leadership. The management has to portray competence in handling police matters and maintaining a culture that supports police standards. This kind of management is supposed to break the strong bonding amongst the police which hinders them investigate their colleagues. The issue of on duty an off duty remain a problem among the New Zealand police. According to leadership theories, a leader remains a leader to at all costs and that he has a duty to those he leads. With such concerns, the male dominated force needs to view the work of the police to be a full, time job with responsibilities to meet. This operates by enhancing public confidence on the police.

In the early sass's, a well-known cereal brand, Kellogg, put out an advertisement for a new product it was producing, vitamins. The ad shows a well-dressed husband standing with his wife, both of whom look happy. The man Is wearing a suit, and the woman Is dressed to clean with her apron on and hand duster. The ad shows the husband saying, ââ¬Å"So the harder a wife works, the cuter she looks. â⬠On the bottom right hand side, you see a little comic of the husband and wife again speaking to each other. The husband says, ââ¬Å"Gosh, honey, you seem to thrive on cooking, cleaning and dusting and I am all tuckered out by closing time.What's the answer? ââ¬Ë The wife responds, ââ¬Å"Vitamins, darling! I always get my vitamins. â⬠This ad is trying to portray the man as hard working and tired, but a woman who, though she is also hard working, isn't tired, and is ready to please her man when he comes home. Kellogg is using sex appeal and gender roles to attract its consumer s; however, this ad would be ineffective today because of its use of logos, ethos, and pathos. Back in the sass's, it is known that woman were the ones that did all the cooking and cleaning throughout the house, while the husband went to work. In the Kellogg ad you see a woman thatIs ready to clean and a man who has Just returned from work. The ad Is portraying a man holding his wife from behind saying ââ¬Å"So the harder a wife works, the cuter she looks! â⬠On the bottom right hand side of the ad you see the husband and wife again, this time facing each other, but again he is holding her. With the husband asking his wife how she seems to thrive on the cooking and cleaning because by the end of the day of work he is all tuckered out. The wife answers by saying, ââ¬Å"Vitamins, Darling I always get my vitamins. â⬠You get the idea that the woman will always be ready for the man.Especially with the way the husband is holding onto her. You can also get a glimpse of the gen der roles that are being viewed. During that era woman had to stay home and maintain the house while the man went to work to make the money. On the left hand side of the ad, there is a tiny Image of a Kellogg PEP cereal box. By looking at the ad you would not know It was supposed to be about cereal. When looking at an advertisement you indirectly come across three approaches to the argument; logos, ethos, and pathos. When you look for the logos you are looking for the reason, or logic, behind the ad and what is making it appeal to the reader.Looking at the vintage Kellogg ad, there are bold letters at the bottom saying, ââ¬Å"Vitamins for pep! Pep for vitamins. â⬠By reading that statement you want to assume that you are looking at an ad for vitamins. If you were to take your vitamins, then you would have the energy that you would need to do your daily tasks, and to also please your husband. The logic would not work today because taking vitamins does not give you substantial h ealth benefits. It is more like that placebo effect, in which people believe that it is doing something for you, but in the long run it is not doing anything t all.Ethos Is the credibility of the ad, so you are looking for the reputation, experience, and Its values of the advertiser. The ad Is showing how Kellogg PEP Is a good source for energy Like vitamins. So you can see that the brand of Kellogg and the reliability of vitamins are an excellent source of nutritional supplement. The brand of Kellogg and the belief that vitamins could give you what your regular diet you the energy that you were made to believe once did. Pathos is the emotion ad is portraying. It uses feelings, desires, and fear to influence your reader.The woman in he picture looks energetic and ready to go do the cooking and all the household chores, such as laundry, dishes, dusting, mopping, etc. The wife feels better than the man after a long day of hard work, and that she is ready to go to please him. With the wife having all the energy, she will be able to perform the acts that her husband desires to make him happy. The pathos would not work today because women do not just stay home and cook and clean. Today woman have more say in the way things are done. Kellogg used ethos, logos, and pathos to attract their consumers.Kellogg sees the idea of taking your vitamins as a supplement to give you energy to do your household chores, and for the woman to please her man. They are using sex appeal to attract more consumers. In that time woman were only allowed to wear dresses to look sexier. The ethos, logos, and pathos would not work today because of their use of sex appeal and gender roles. Today, women are able to go to work and not Just be a stay at home wife. Women have more options. By looking at the advertisement, you would not know that it was about Kellogg if it did not have the little logo box in the bottom left corner.
